About The Fair Housing Act (FHA) - Are You Covered?
The Fair Housing Act requires that new multifamily housing with four or more units be designed and built to allow access for persons with disabilities. This includes accessible routes into and through the dwelling, doors wide enough to accommodate persons who use wheelchairs, outlets and environmental controls at accessible heights, bathroom walls that have reinforcements for the installation of grab bars, as well as bathrooms and kitchens that are large enough for people who use wheelchairs to maneuver, and other adaptable features within the units. Unfortunately, many owners and developers have their Architects and Engineers concentrating on the minimum 2% requirements only and are not aware of the 1988 Fair Housing Amendments Act, which Congress passed to expand the coverage of Title VIII to prohibit discriminatory housing practices based on disability and familial status and gives people with disabilities greater freedom to choose where they live.
Translating the FHA guidelines into properly dimensioned living space can be difficult. The MBP team will provide specific inspections to verify dimensional requirements of the FHA guidelines and/or Americans with Disabilities Act (ADA). We work throughout the construction of the project to alert the project owner of construction or design errors so they can be remedied before completion of the project.
MBP will provide a written report of deficiencies with an FHA/ADA Accessibility Checklist intended to determine compliances with the Fair Housing Act Regulation 24 CFR 100.205 Design Manual as it relates to units, sites, and common areas.
